Legal Requirements

  • Mains-powered smoke alarms with battery backup
  • Minimum two RCDs covering all power and lighting circuits
  • All devices must be compliant, correctly placed, and functional

Before Leasing
A current compliance certificate is required.

WA Pool & Spa Fencing Requirements (Rental Properties)

When is a Fence Required?

  • Any pool or spa (including portable) with water over 300mm deep must have a compliant safety barrier.
  • Applies regardless of who installed it—tenant or landlord.
  • Barriers must comply with:
    Building Act 2011 and Regulations 2012
    – AS 1926.1:2012 (barrier safety)
    – AS 1926.2:2007 (barrier location)
    – Pools built before May 2016 may use AS 1926.1:1993 if compliant and maintained.

Barrier Requirements

  • Min. height: 1,200mm
  • Ground clearance: Max 100mm
  • No climbable objects within 900mm of the inside of the barrier

Gates & Access

  • Must be self-closing, self-latching, and open away from the pool
  • Latches must be childproof and positioned high
  • Gates and doors must auto-close and latch

Security 

Minimum Security Standards for WA Rental Properties

To comply with WA legislation, rental properties must meet the following security standards:

Main Entry Door

  • Must have a deadlock or
  • A key-lockable security screen (AS 5039-2008 compliant)

Other External Doors

  •  Must have a deadlock or, if unsuitable:
      – A patio bolt lock, or
      – A key-lockable security screen (AS 5039-2008 compliant)

Windows

  • Must have a lock or latch to prevent opening from outside
  • Keyed locks not required, but locks must be functional and secure
  • If fitted with a compliant security screen (AS 5039-2008), a separate window lock is not required

External Lighting (Main Entry)

  • Must have an electrical light at or near the main entry
  • Light must illuminate the entry and be operable from inside
  • Not required for flats/apartments with strata-managed common lighting

Blind & Cord Safety – Key Requirements

Blinds must comply with the Trade Practices Regulations 2010

 Warning Label:

  • All corded internal window coverings must display a warning label or swing tag with the following message:
    “WARNING: Young children have died by wrapping loose curtain and blind cords or chains around their necks. Secure cords or chains with cord guides or keep them out of reach by winding them around a cleat. Move cots and furniture away from window covering cords or chains. Do not remove this label.”
  • Must prevent cord loops ≥220mm below 1,600mm from floor.
  • Cord guides below 1,600mm must securely tension cords and prevent child access.
  • Cleats must be installed 1,600mm or higher.
